These terms and conditions apply to the ROX Tickets app (hereby referred to as "Application") for mobile devices that was created by ROX Tickets (hereby referred to as "Service Provider") as a Free service.
Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.
The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advises against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly or at all.
Please note that the Application utilizes third-party services that have their own Terms and Conditions. Below are the links to the Terms and Conditions of the third-party service providers used by the Application:
Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.
If you are using the application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the application, or other third-party charges. By using the application, you accept responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the application, they assume that you have obtained permission from the bill payer.
Similarly, the Service Provider cannot always assume responsibility for your usage of the application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.
In terms of the Service Provider's responsibility for your use of the application, it is important to note that while they strive to ensure that it is updated and accurate at all times, they do rely on third parties to provide information to them so that they can make it available to you. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the application.
The Service Provider may wish to update the application at some point. The application is currently available as per the requirements for the operating system (and for any additional systems they decide to extend the availability of the application to) may change, and you will need to download the updates if you want to continue using the application. The Service Provider does not guarantee that it will always update the application so that it is relevant to you and/or compatible with the particular operating system version installed on your device. However, you agree to always accept updates to the application when offered to you. The Service Provider may also wish to cease providing the application and may terminate its use at any time without providing termination notice to you. Unless they inform you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the application, and (if necessary) delete it from your device. The Service Provider may terminate ac account at its sole discretion without any notice or reason.
ROX Tickets provides a service that allows members who want to buy tickets ("Buyers") to find members who want to sell tickets ("Sellers"). ROX Tickets does not take title to the underlying ticket and the actual transactions are between the Buyers and Sellers. Once Buyer and Seller have entered into a transaction, all transactions are covered by the ROX Tickets Guarantee.
When You purchase tickets on ROX Tickets, ROX Tickets guarantees that You will receive the tickets You paid for in time for the event. In the rare instance that a problem arises , ROX Tickets will, in its sole and absolute discretion, review comparably priced tickets and offer You replacement tickets at no additional cost, or ROX Tickets will issue You a refund for the cost of the tickets. "Comparably priced" replacement tickets are determined by ROX Tickets in its sole and absolute discretion.
To post a ticket for sale on ROX Tickets You must first register with the app. Once a ticket is posted, We strongly discourage posting that ticket for sale elsewhere. If You do post your ticket for sale on other marketplaces, you are required to remove your ticket from the app immediately if your ticket sells elsewhere. Except as provided herein, You agree not to promote the sale of tickets posted on ROX Tickets through any other site. We reserve the right to prohibit users from posting tickets on ROX Tickets
ROX Tickets shall only be liable for damage caused by ROX Tickets as well as by their legal representatives, executive employees or other vicarious agents intentionally or through gross negligence or in the case of injury to life, body or health. The liability of ROX Tickets subject to the above, shall be limited to the actual and direct damage incurred by You andROX Tickets shall not be liable for example for travel costs, hotel costs or loss of profit, unless ROX Tickets was acting intentionally or through gross negligence, or in the case of injury to life, body or health.
You acknowledge and agree that the foregoing disclaimers and limitations of liability represent reasonable allocations of risk, and that the pricing and other terms and conditions of this agreement reflect such allocations of risk.
We are not involved in the actual transactions between Buyers and Sellers. If You have a dispute with one or more members, You release ROX Tickets and all affiliated companies, officers, directors, agents, parents, subsidiaries, legal representatives and employees from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such dispute.
If We change this Agreement, We shall post a revised version of this Agreement, which shall automatically replace the terms of this Agreement. The revised version of this Agreement is automatically effective after it is initially posted on the Site. Your continued use of the Site and the Services following ROX Tickets's posting of a revised Agreement will constitute Your acceptance of the revised Agreement. If You do not agree with the terms of this Agreement or any revised version of this Agreement, do not continue to use the Services or this Site.
To be a member of this app, You must agree to accept the terms in this Agreement. You may only use the Services if You can legally enter into and form binding contracts. If You do not qualify, do not use the Services.
We will not allow You to buy or sell tickets before You have registered with Us. To register, You must provide your full name, address, phone number, and email address.
You will need a username and password to access the Site and use the Services. You are responsible for maintaining the security of your username and password and You are responsible for any action taken under your username or password.
Once you buy a ticket, it is sent to your app. Tickets cannot be exchanged or refunded after purchase. In the event there is an issue with your ticket, for example the seller has listed it for a different day than advertised, you need to notify us within 24 hours to allow the issue to be resolved. If you do not notify us in that time period then you need to resell the ticket and buy another ticket. You need to change the name on the ticket as soon as you get the ticket without delay, failing to do so may result in you not being able to race. The event organisers may charge a name change fee, which the ticket buyer is responsible to pay. You agree to abide by the ticket terms and conditions of the event organiser. Please check that all the details on the ticket are correct before you book any flights or accomodation. The maximum refund given will be the price paid for the ticket on the platform, we are not responsible for anything relating to name changes or any other costs incurred. We may cancel a ticket sale at anytime at our discretion.
Wishlist is a premium subscription service on the app which allows the user to get notification when tickets on their wishlist are added. It is a 12 month subscription. Subscriptions are non refundable.
The Service Provider may periodically update their Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the new Terms and Conditions on this page.
These terms and conditions are effective as of 2024-07-25.
