These Terms and Conditions apply to the ROX Tickets app (hereinafter referred to as the “Application”) for mobile devices, which is provided by ROX Tickets (hereinafter referred to as the “Service Provider”) as a free service.
By downloading, accessing, or using the Application, you agree to be bound by these Terms and Conditions. You are strongly advised to read and understand these terms before using the Application.
Unauthorised copying or modification of the Application, any part of the Application, or our trademarks is strictly prohibited. You may not attempt to extract the source code of the Application, translate the Application into other languages, or create derivative versions of the Application. All trademarks, copyrights, database rights, and other intellectual property rights relating to the Application remain the property of the Service Provider.
The Service Provider is committed to ensuring that the Application is as beneficial and efficient as possible. Accordingly, the Service Provider reserves the right to modify the Application or charge for its services at any time and for any reason. Any charges relating to the Application or its services will be clearly communicated to you before they are incurred.
The Application stores and processes personal data that you provide to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone or other device and your access to the Application.
The Service Provider strongly advises against jailbreaking or rooting your device. Doing so involves removing software restrictions and limitations imposed by the official operating system and may expose your device to malware, viruses, or other malicious programs. It may also compromise your device's security features and result in the Application not functioning correctly or at all.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom, and the parties agree to submit to the exclusive jurisdiction of the courts of the United Kingdom in relation to any dispute arising out of or in connection with these Terms and Conditions.
The Application uses third-party services that are subject to their own terms and conditions. These include:

Certain functions of the Application require an active internet connection, which may be provided through Wi-Fi or your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity because you do not have access to Wi-Fi, mobile data, or an adequate internet connection.
If you use the Application outside a Wi-Fi area, the terms and conditions of your mobile network provider will continue to apply. You may incur charges from your mobile network provider for data usage or other third-party charges.
By using the Application, you accept responsibility for any such charges, including roaming charges incurred when using the Application outside your home territory, region, or country without disabling data roaming.
If you are not the bill payer for the device on which you use the Application, you confirm that you have obtained permission from the bill payer to use the Application.
You are also responsible for ensuring that your device remains operational and sufficiently charged. If your device runs out of battery or otherwise becomes unavailable and you are unable to access the Service, the Service Provider cannot be held responsible.
While the Service Provider strives to ensure that information provided through the Application is accurate and up to date, it may rely on third parties to provide certain information. The Service Provider accepts no liability for any direct or indirect loss arising solely from your reliance on such third-party information or functionality, subject to applicable law.
The Service Provider may update the Application from time to time.
Operating system requirements and compatibility requirements may change, and you may be required to download and install updates in order to continue using the Application.
The Service Provider does not guarantee that it will always update the Application so that it remains compatible with every version of every operating system or device. However, you agree to accept updates to the Application when they are made available and are required for continued use.
The Service Provider may cease providing the Application and may terminate your right to use it at any time, subject to applicable law.

ROX Tickets provides a service that allows members who wish to purchase tickets (“Buyers”) to find members who wish to sell tickets (“Sellers”).
ROX Tickets does not take ownership of the underlying ticket. The actual transaction for the ticket is between the Buyer and the Seller.
Once a Buyer and Seller have entered into a transaction through the Application, the transaction is covered by the ROX Tickets Guarantee, subject to these Terms and Conditions.
Tickets are listed at their face value plus, less any insurance premium suck as flex, applicable ROX Tickets fees, subject to any restrictions imposed by applicable law.
It is the Seller's responsibility to remove any personal information from a ticket before listing it for sale, where this is possible.
When you purchase a ticket through ROX Tickets, ROX Tickets guarantees that you will receive the ticket you paid for in sufficient time for the relevant event.
In the rare event that a problem arises with your ticket, ROX Tickets will, at its discretion and subject to these Terms and Conditions, either:
The availability and suitability of a comparably priced replacement ticket will be determined by ROX Tickets at its discretion.
To list a ticket for sale on ROX Tickets, you must first register with the Application.
When creating a listing, you may be required to provide a link to the ticket you originally purchased. This ticket may contain the Seller's personal details.
Tickets accessed through external ticket links are not within the direct control of ROX Tickets, and ROX Tickets does not control the personal data or other information displayed on third-party ticketing platforms.
Tickets are listed at face value, excluding any insurance policies or other non-transferable products included with the original ticket.
By uploading or providing access to a ticket containing your personal data, you consent to that data being shared with prospective Buyers to the extent necessary to facilitate the sale and transfer of the ticket.
Once you have listed a ticket on ROX Tickets, we strongly discourage you from listing the same ticket for sale elsewhere.
If you list your ticket on another marketplace and it sells elsewhere, you must immediately remove the ticket from ROX Tickets.
Except as otherwise permitted by these Terms and Conditions, you agree not to use another website, marketplace, or platform to promote the sale of a ticket that is listed on ROX Tickets.
ROX Tickets reserves the right to prohibit or restrict users from listing tickets on the Application where appropriate.
Where an error in pricing or listing information has been confirmed, ROX Tickets may cancel the transaction and refund the Buyer.
ROX Tickets may also refund a Buyer where a Seller removes or is unable to provide a ticket after it has been sold.
Sellers are responsible for ensuring that all information contained in their listings is accurate. A Seller may be required to refund a Buyer where the Seller has made an error in a listing.
ROX Tickets reserves the right to hold funds due to a Seller until after the relevant event has taken place where ROX Tickets reasonably considers there to be a risk that the Buyer may be unable to use the purchased ticket.
In certain circumstances, ROX Tickets reserves the right to withhold the release of funds to a Seller for up to 60 days after the relevant competition or event has ended, subject to applicable law.
To the fullest extent permitted by applicable law, ROX Tickets shall only be liable for damage caused intentionally or through gross negligence by ROX Tickets, its legal representatives, executive employees, or other agents, or in circumstances involving injury to life, body, or health where liability cannot lawfully be excluded.
Subject to applicable law, ROX Tickets' liability shall be limited to the actual and direct loss suffered by you.
ROX Tickets shall not be liable for indirect or consequential losses such as travel costs, accommodation costs, or loss of profit, except where such liability cannot lawfully be excluded or where ROX Tickets has acted intentionally or through gross negligence.
Nothing in these Terms and Conditions excludes or limits any liability that cannot lawfully be excluded or limited.
You acknowledge and agree that the disclaimers and limitations of liability contained in these Terms and Conditions represent a reasonable allocation of risk between you and ROX Tickets and that the pricing and other terms of the Service reflect that allocation of risk.
ROX Tickets provides a marketplace that facilitates transactions between Buyers and Sellers and is not the underlying event organiser or original ticket issuer unless expressly stated otherwise.
If you have a dispute with another member relating to a transaction, you agree that ROX Tickets and its affiliated companies, officers, directors, agents, parent companies, subsidiaries, legal representatives, and employees will not be responsible for claims, demands, or damages arising solely from that dispute, except where ROX Tickets has separate liability under these Terms and Conditions or applicable law.
ROX Tickets may amend these Terms and Conditions from time to time.
Where these Terms and Conditions are changed, a revised version will be made available through the Application, website, or other appropriate means.
Your continued use of the Application or Services after revised Terms and Conditions become effective constitutes your acceptance of the revised Terms and Conditions.
If you do not agree to these Terms and Conditions or any revised version of them, you must stop using the Application and Services.
To become a member and use the Application, you must agree to these Terms and Conditions.
You may only use the Services if you are legally capable of entering into a binding contract. If you are not legally capable of entering into a binding contract, you must not use the Services.
You may not buy or sell tickets through ROX Tickets until you have registered for an account.
To register, you must provide the information requested by ROX Tickets, which may include your:
To sell tickets, you must create and maintain a Stripe Connect account through our system where required for the processing of Seller payments.
You are responsible for maintaining the confidentiality and security of your username, password, and other account credentials.
You are responsible for activity carried out through your account using your username and password, except where unauthorised access results from circumstances for which ROX Tickets is legally responsible.
You should notify ROX Tickets promptly if you believe that your account or login credentials have been compromised.
Once you purchase a ticket, it will be delivered to or made accessible through your account in the Application.
Except where otherwise provided by these Terms and Conditions or required by applicable law, tickets cannot be exchanged or refunded after purchase.
If there is an issue with your ticket—for example, if the Seller has listed the ticket for a different day from the one advertised—you must notify ROX Tickets within 24 hours of receiving or accessing the ticket to allow us an opportunity to investigate and resolve the issue.
If you do not notify us within this period, you may be required to resell the ticket and purchase the correct ticket, subject to your statutory rights and the ROX Tickets Guarantee.
If a Buyer purchases the incorrect ticket due to the Buyer's own error, the purchase is non-refundable, except where otherwise required by applicable law.
You are responsible for completing any required name change on the ticket as soon as possible after receiving it. Failure to complete a required name change may result in you being unable to participate in the event.
The event organiser may charge a name-change or ticket-transfer fee. Any such fee is the responsibility of the Buyer unless otherwise stated.
By purchasing a ticket through ROX Tickets, you agree to comply with the applicable terms and conditions of the relevant event organiser.
You should check that all information on your ticket, including the event, date, division or category where applicable, and participant details, is correct before booking flights, accommodation, transport, or other associated services.
Where a refund is payable by ROX Tickets, the maximum refund will ordinarily be the amount paid for the ticket through the platform, excluding insurance costs or other non-refundable third-party products, except where applicable law requires otherwise.
ROX Tickets is not responsible for name-change fees, travel expenses, accommodation expenses, or other consequential costs incurred in connection with a ticket, except where such liability cannot lawfully be excluded.
ROX Tickets sells fitness race tickets. Spectator tickets are not sold separately through the ticket exchange unless they are included with, or form part of, a race ticket.
ROX Tickets reserves the right to cancel a ticket sale where reasonably necessary, including in cases of suspected fraud, listing errors, duplicate sales, invalid tickets, or breaches of these Terms and Conditions.
The standard fee for a ticket sale depends on the currency in which the ticket is sold.
The applicable standard fees are:
Fees are normally payable by the Buyer.
Where applicable law or regulations prohibit a ticket from being sold above its permitted face value, the applicable ROX Tickets fee may instead be charged to the Seller.
All applicable fees will be displayed or communicated before the relevant transaction is completed.
Wishlist is a premium subscription service available through the Application. It allows users to receive notifications when tickets matching items on their Wishlist are listed.
A Wishlist subscription lasts for 12 months from the date of purchase unless otherwise stated at the time of purchase.
Wishlist subscription fees are non-refundable except where a refund is required by applicable law.
The Service Provider may periodically update these Terms and Conditions.
You are advised to review these Terms and Conditions regularly to ensure that you remain aware of any changes.
Where appropriate, the Service Provider will notify you of changes by posting the updated Terms and Conditions through the Application or on the relevant webpage.
These Terms and Conditions were originally effective from 25 July 2024 and may subsequently be updated from time to time.
